On 5 separate occasions Bank of America handed money from my account to a criminal with a fake ID. His signature wasn’t even remotely close to the hundreds, no thousands of signatures that Bank of America has on file for me. They handed him almost 26k one day, and later on that day, another $12,500. Same day. I found the guy on Instant Checkmate… turns out he’s a hardened criminal with a ton of identity theft charges.
Since then, I have missed work twice, spent aproximately 20 hours on the phone, email, or in a Bank of America branch. I’ve been given phone numbers and I’ve been told “You gotta call here” only to find out I needed to call somebody else.
But inconvenience isn’t the problem. It’s the gross negligence of 5 separate banking centers. it’s the lack of motivation that Bank of America has exhibited in the past few weeks in giving me my money back. It’s the fact that I have missed several business opportunities because my checking account has dried up and my card isn’t working. It’s the late bills, which will affect my credit.
In the upcoming days, I’ll be writing my story in detail about how my identity was stolen, how my bank account was cleared out, and how Bank of America has handled the situation. People need to know how this bank operates, it’s a huge bank handling a *lot* of your finances.
I’ll also be looking for others who have had similar experiences, and perhaps a few opportunistic lawyers who have the wherewithal to stand up against Bank of America in a class action lawsuit, for being grossly negligent and negatively affecting the lives of their customers.

Sometimes contacting the PR/marketing dept and telling them you practice the dark art of seo and have a lot of influential buddies in the social media world can move things along a bit.
I know someone who had something similar happen and he simply went up the chain and contacted the CEO about his experience.
After that, things happened very quickly.

Your story about B of A’s gross negligence, indifference, incompetence or anything else you want to call it is amazingly similar to our story. Keep me in the loop. I too am getting ready to hire an attorney to seek not only specific performance of removing the fraudulent debt from our records, but to seek the most excrutiatingly painful amount of punitive damages! I typically don’t use this four letter word, but I HATE Bank of America.

I just had the same thing happen to me this weekend. The bank failed to close out a card that I had lost over 5 mos ago. Someone found the card and took all the money out of my account. And all the bank could do was say that they would give me a letter of apology. Just let me say that I am currently looking for an attorney to represent my case. I went through the same thing that you were talking about. I went to three different branches and no one seems to have an answer and that now that my creditors are calling i have no other explanation for them other than the bank is giving me only what the people stole but i believe that i should be compensated for all the time off of work and hours on the phone since all this started. all i know is that a letter of apology is not good enough for me. i am def. interested in the class action suit.

Today i went and made a deposit of 10.00 today because i do not want this on my credit report. Anyone that has any information on how i can get this settled would be greatly appreciated.

i just got off the phone with bank of america.i told them that this was the fourth time they did this to me and it was B.S.
i am on S.S.I. and only get somewhere around $500.00 a month and they are giving my money to someone who does not need my money.tell me how i am supost to live when they say my account is over drawn and i cant even pay my rent.

I am anxious to correspond with who ever posted their original concern. Your story is almost identical to mine. On four seperate occasions, (2) in Florida, (1) in San Jose, Ca. and (1) in Pleasanton, Ca. individuals possessing my California DL with my identifying info. but the suspects photo and a credit card in my name entered these B of As. In Florida they made 2 $3000 withdrawals, in San Jose the teller was smart enough to recognize a fake ID and called LE. She was arrested and remains in Santa Clara Co. Jail pending these charges. In Pleasanton, the person took $4800. This incident occurred after I put all the safe guards on my account that B of A told me to do. Furthermore, it is suspected that an employee of B of A sold mine and numerous other’s info. to the black market of identity thieves. When the suspect, Tomika Baca, was arrested in San Jose, she was in possession of every item of info. that you would give a bank when opening an account. SS#, CDL, name, spouse, mother’s maiden name, date account opened, how much was in my savings and checking and int eh account which I was on with my father. Of course no one there takes any responsibility. They send you from the Check Fraud Dept. to the Identity Theft Dept. to Customer Service to the Branch and they always screw up. When they screw up, they tell you tha tyou filed the wrong paperwork.
Since, Nov. 4, 2008, I have spent almost every waking hour trying to protect myself, file reports, file claims, send emails, make phone calls, etc. B of A is to blame for this (although it is unlikely it will ever be proven that they leaked my info. This has taken a toll on my emotionally and psychologicall, somewhat financially. I am a complete mess.
Anyone who is interested in filing a suit, I am game? Please let me know. I live near Sacramento and will likely attempt to contact an attorney in that town.

I have a story as well with Bank of America they rank one of the top two banks for identity theft. In my case they didn’t even provide any ID and they walked out with huge amounts of cash.

I have a story where boa accepted counterfiet checks from a person posing as me in california ( I live in florida) they cashed them and then took the money out of my account. They did not ask for I’d, did not know the person (as they were a criminal) and accepted 10 checks at two branches all in 15 minutes. The bank is negligent and failed to follow basic endorsement rules as well as their own internal policies
As a result I lost $10000 this is a grand theft case and I believe that the two tellers that accepted the checks could have been involved. The bank of course has not done the right yet. I am given them three more days before I go public.

Good luck. I had a similar issue with my office manager. she stole my identity and opened up a corporate credit card with the #5 credit card bank in US. (Rymes with Manta, I cant say there name as we are suing the crap out of them).
She then preceeded to wire transfer out of my checking account over $200,000.00 She was not paying suppliers yet all the numbers were good and the accounts all balanced…but she was forging numbers to make it look good.
I asked the bank to refund money and they said no, I was reckless and too bad. I am suing them for negligence and they now say they are not negligent either. Hmmm arguing both sides of same coin.
Here is the rub, they did not follow underwritting proceedure and saw my personal credit rating of 790+ and shit hte bed and gave her the card. Funny, my card was never used, only the employee card was used…for everything including brest implants.
Any the bank says I’m reckless. I even have testimony on record whereby they have, as it appears to be lying ot the investors.
The bank has threatened me into oblivian if I publish a pres release regarding this even though I am printing the truth.
Bottom line, our current bank issue and up coming credit card issues are strickly due to bank negligence in how they have investigate peopel and thier underwritting processes.

I’m not sure if you would still this as I see you posted this; however I have a horrible experience with BOA. They released to someone $1.6 million from my accounts. Then did not incestigate and charged me $4000 in NFS fees and reported to me to the check systems and locked my other accounts.

My bank of america saving account was stolen with online transfers to a checking account. I don’t have a checking account with bofa. I received quarterly statements. Due to the fact the transfer is over 60 day old them couldn’t help me. What? That’s my money and them can’t tell me what happen to it. That’s just wrong, not investigating a crime to see what happen to my funds, I’m very up set.

I agree with you guys Bank of America is negligent about when it comes to fraudalent charges. One time i had my outgoing mail stolen in which i had about five checks going out for payments. One by one were cashed in the same branch. i filed claims for the first one when it happened, and then i had to file for the next one and the next one. You would think they have like an alert system or something.
Just recently i have been charger $350 in overdraft fees by an oversight on my part and i called and begged them, crying, pleading to put my money back in my account becuase i need it for other payments , and they’re only response was ” i am sorry, there is nothing we can do”. that is just ruthless, indifferent. I am ready for a “class action lawsuit”.

I hate this bank. Have a long history and for some reason every couple years there is somne kind of fraud on my account or I’ll be in store and my card is declined because they just decided to shut it off for something suspicious but didnt think it necessary to inform me so there I am terribly embarrassed. THis recent stunt though is hurting me bad I just want to cry. I had over 60 grand in a couple accounts and all of a sudden two are wiped and they locked down the other but they wont even tell me whats going on. I had to report and talk to people who keep sending me to other people but they wont let me touch my money MY MONEY at all and I have FIVE kids to feed bills to pay my life is going to be ruined I will lose my kids I will lose my house my cars everything because they wont give me money not even the money that was stolen the money they locked after the other was stolen its MY MONEY what right do they have to keep me from it? I’m almost completely out of food I don’t know what to do I’ve never not been able to feed my kids I just got this house two months ago things were finally looking up and now this. I hate this bank I just felt a certain loyalty but they are ruining my life and I don’t understand how they have the right to keep my money from me.

Just got off the phone with BofA myself. Had my account compromised last February. Identity theft from a stolen wallet. Was called by the bank and informed of a suspect check for $700. About $1,700 had been siphoned out of my account, with about a grand in online transactions, including paying their gas and electric bill with my account and paying their cell phone bill with my account, so I was able to see their names on my account.
The bank refunded me all the money, I copied all the information and gave it to the police, copies of the names and accounts and the forged check and forgot about it.
Did do some research on one of the names, and they came up online as a trust fund baby from the family of a famous author. I saw the same homes being sold between several family members again and again and again, the same several homes being sold between family members approximately twenty times over five years???? Never heard anything from the police. Months went on. I forgot about it.
So I checked my account yesterday, and the bank had taken over $950 dollars from my account, reversing the cash they’d credited back to me, without informing me. The bank took $950 out of my account without telling me.
So I’m heading to the sheriff station today to get a copy of my report and see what progress they’ve made in their professional effective highly salaried endeavors(*snicker*) on the case. Then I’m heading to BofA to find out if it is legal for them to withdraw cash out of my account without informing me, display the police report to them, and go from there.

Bank of America allowed a woman to open accounts in two states using my husband’s social security number, which was stolen in 2006 when laptop containing social’s for veterans was stolen. She wrote numerous bad checks, which were then reported to chexsystems as fraud and sent to collections. Bank of America didn’t even bother to notify us. Thanks Bank of America!

I have banked with Bank of America for over 14 years!
I had somebody steal my identity and you would not believe
what has happened to me!!! My bank allowed my closed account opened 3 times over drawn thousands from my son’s savings to my checking – then linked closed account to new new account and son’s savings!!! That is just the start of ugly. You would be horrified to know the truth of their mistakes and still have not corrected!!!!!

I have just had a similar experience. Bank of America allowed someone to change my address to a fraudulent address four hours from my home. They never checked with me. I received a postcard in the mail advising that my address change had been completed. What????? I didn’t authorize that. I immediately went to the bank on Monday. They had allowed someone to open a new checking and savings acct. in my name and issued debit cards to a fraudulent address. Within a couple of days, the thieves went through over $10,500. Four ATM withdrawls on the same day from the same teller. Three more ATM withdrawls at another machine on the same day. Almost $4,500 at a grocery store. Teller agent assisted transfers via phone totaling 9500 in one day. As of yet, they have not put the money in my account. I have spent hours trying to resolve this situation and now my identity is out there. This account normally has 5 transactions over two months. Shouldn’t they have safeguards in place? Someone should have caught this. If anyone knows of a Class Action, please post the information. I see that they were sued for a similar situation in California in 2007. I guess things have not changed.

My brothers life has literally been destroyed by this bank. His ss# led thieves to his 401k and all other accounts as well were wiped out. A lifetime of work and savings gone,but according to the IRS he should be living it up on this money and although currently unemployed is NOT ELIGIBLE for assistance of any type–food stamps,cash,etc. The thieves are getting away with all of this! He has hired an attorney in the Charlotte area but he wants more money. Is there any real help out there????

I tried to have my VISA card details stolen. First they made an attempt to see if the card worked, by buying opera tickets for somewhere in Canada..??!? Later that day they bought a lot of goods from another online store. The next day i checked my bank accounts and noticed the problem and had the card terminated :-(

Chris last year my home loan application with BofA was sent to a little town in Texas a few months later just 12 miles away from that office someone bought a lexus under my name and so far I can not get anyone to investigate the matter I have filed a police report. not living in Texas it was funny how this theft came from there. I do have the names of the people that handled my information. the police will do nothing. now my credit score went from a 750 to now 440. I know the B of A employee sold my information or just gave it to someone she knew. it is not the bank it is the emoloyees. if anyone has had this problem please let me know. I want my idenity back and my police need to talk to you police.

Although I think this is probably written by someone who is probably about twelve years old it is still a typical example of the mindset of these assholes.
The fact is they do not have the mental capacity to be able to understand the pain and desperation their actions cause. I am a great believer in what comes around goes around, I hope Chris the guy who stole your money has been given many years to think about what he did. Although once he gets out he will no doubt be straight back to a life of crime. They don’t have the balls to do anything else!

My boyfriends ex wife forged a document releasing $54,000 from his 401k with BAO. He was working for BOA on a work visa and was intimitaded to drop the matter by the bank as he worked for BOA. As soon as the funds were released she transfered the funds within hours to a title company for a property in her Aunt’s name. He was fired just a few days ago and the bank will not even speak to him about his money or email him back. Also, he recieved a large tax liability for the money the ex wife took. He put a stop form on file months before she did this and even submitted the form to protect this from happening months before hand, she altered a previous release of funds form without even changing the previuos date, therefore they have the original to compare that it was an altered copy she sent in. This is identy theft, forgery, bank fraud, money laundering and fraudulent conveyance. Yet the DA is so busy with a Hollywood production of the Hemy Nueman murder trial here in ATL not a single call has been returned in regards to the report being filed. My boyfriend has been here for ten years and was a few weeks away from getting his greencard with BOA and now he has no job and they let his money be stolen, and left him having to owe IRS thousands because of what they did. I even have emails where the bank atmitted he put a realease stop on his account before this happened and that date on the document she forged/altered predated his stop form on his account. I even have many emails and text where she admits she stole it!

I had a horrific amount over $20,000.00 taken from my Personal Interest Maximizer account in Dallas,Oregon in 2001.I had received $40,000.00 as my share of the house my husband and i bought for my settlement. My husband always took care of all finances, bills, banking etc…, and i was stupid enough to tell the Banker that opened my accounts this and i believe he was the one who stole the majority of this money through something called Tellatransfers and ATM withdrawl of $250.00 six times a day and he had me sign a blank check for $500.00 when i opened the accounts and told me it would be used if i had to cover overdraft charges or transfer money if the other of my accounts got withdrawn. I went in person to talk to him and he went in back and came out 10 minutes later and said that everything looks fine on my accounts, i requested the account numbers be changed and told him my atm gold visa BofA bank card that he had taken my picture to go on it had never arrived and i want pictures of all the transaction and the people on camera at that atm as it was at that same branch and i rarely used the atm there. He was rude and the teller i spoke to were very rude and told me my accounts were all overdrawn and that i was no longer a customer of B of A and to leave and that there was no camera on their ATM machine in Dallas, Oregon. Bullshit they all have cameras and when i asked for copys of all my statements i was told i would have to pay 450- for copies of them. “This was in 2001″ I havnt had any money or bank accounts since then and i am physically disabled and on ssi and live on housing. My daughter is terminally ill with Cystic Fibrosis and i would have loved to give her some of the things that might help make her life better.
