On 5 separate occasions Bank of America handed money from my account to a criminal with a fake ID. His signature wasn’t even remotely close to the hundreds, no thousands of signatures that Bank of America has on file for me. They handed him almost 26k one day, and later on that day, another $12,500. Same day.
Since then, I have missed work twice, spent aproximately 20 hours on the phone, email, or in a Bank of America branch. I’ve been given phone numbers and I’ve been told “You gotta call here” only to find out I needed to call somebody else.
But inconvenience isn’t the problem. It’s the gross negligence of 5 separate banking centers. it’s the lack of motivation that Bank of America has exhibited in the past few weeks in giving me my money back. It’s the fact that I have missed several business opportunities because my checking account has dried up and my card isn’t working. It’s the late bills, which will affect my credit.
In the upcoming days, I’ll be writing my story in detail about how my identity was stolen, how my bank account was cleared out, and how Bank of America has handled the situation. People need to know how this bank operates, it’s a huge bank handling a *lot* of your finances.
I’ll also be looking for others who have had similar experiences, and perhaps a few opportunistic lawyers who have the wherewithal to stand up against Bank of America in a class action lawsuit, for being grossly negligent and negatively affecting the lives of their customers.

Sometimes contacting the PR/marketing dept and telling them you practice the dark art of seo and have a lot of influential buddies in the social media world can move things along a bit.
I know someone who had something similar happen and he simply went up the chain and contacted the CEO about his experience.
After that, things happened very quickly.

Sorry about the troubles, Chris. I’ve had BOA for years and they’ve been fine (knock on wood).
Just curious though - why do you have so much cash in a regular bank account? You’re a young guy - you should be taking some risks with the stock market.

I’ll start taking risks in the stock market when there are signs of life. I have some tied up in mutual funds, and it has been shrinking over the past few months.

Chris, I am so sorry to hear about your plight. I always wondered how these scam artist pull this off. I can barely get $20 out of my bank without going through an inquisition. Let me know if there’s anything I can do to help.

that’s crazy dude! of the two banks I work with, NEITHER of them allow more than $2 g’s to come out through the drive-thru and no more than $4 g’s inside with the teller! BoA dropped the ball on that one, but I’m glad you got it all back.

Your story about B of A’s gross negligence, indifference, incompetence or anything else you want to call it is amazingly similar to our story. Keep me in the loop. I too am getting ready to hire an attorney to seek not only specific performance of removing the fraudulent debt from our records, but to seek the most excrutiatingly painful amount of punitive damages! I typically don’t use this four letter word, but I HATE Bank of America.

I just had the same thing happen to me this weekend. The bank failed to close out a card that I had lost over 5 mos ago. Someone found the card and took all the money out of my account. And all the bank could do was say that they would give me a letter of apology. Just let me say that I am currently looking for an attorney to represent my case. I went through the same thing that you were talking about. I went to three different branches and no one seems to have an answer and that now that my creditors are calling i have no other explanation for them other than the bank is giving me only what the people stole but i believe that i should be compensated for all the time off of work and hours on the phone since all this started. all i know is that a letter of apology is not good enough for me. i am def. interested in the class action suit.

I would like to know what happen with this case because i had someone clean out my accounts. I called the bank they told me not to worry they would handle everything and replace my money. They put the money back in my account and then took it back out about 2 weeks later and said there was no fraud on my account and therefore i was responsibe for the money. I am still fighting with the bank and writing letters trying to get this figured out. they are now saying they are going to put this on my credit report because i closed my account with them because i can not afford to pay them that money twice. Today i went and made a deposit of 10.00 today because i do not want this on my credit report. Anyone that has any information on how i can get this settled would be greatly appreciated.

i just got off the phone with bank of america.i told them that this was the fourth time they did this to me and it was B.S.
i am on S.S.I. and only get somewhere around $500.00 a month and they are giving my money to someone who does not need my money.tell me how i am supost to live when they say my account is over drawn and i cant even pay my rent.

Has anyone sued BofA for not properly identifying their customers. I’m sure they are up for a class action lawsuit and people can pull together to make it happen. And…I’m sure they monitor any websites with their name listed on it. Just an FYI.

I am anxious to correspond with who ever posted their original concern. Your story is almost identical to mine. On four seperate occasions, (2) in Florida, (1) in San Jose, Ca. and (1) in Pleasanton, Ca. individuals possessing my California DL with my identifying info. but the suspects photo and a credit card in my name entered these B of As. In Florida they made 2 $3000 withdrawals, in San Jose the teller was smart enough to recognize a fake ID and called LE. She was arrested and remains in Santa Clara Co. Jail pending these charges. In Pleasanton, the person took $4800. This incident occurred after I put all the safe guards on my account that B of A told me to do. Furthermore, it is suspected that an employee of B of A sold mine and numerous other’s info. to the black market of identity thieves. When the suspect, Tomika Baca, was arrested in San Jose, she was in possession of every item of info. that you would give a bank when opening an account. SS#, CDL, name, spouse, mother’s maiden name, date account opened, how much was in my savings and checking and int eh account which I was on with my father. Of course no one there takes any responsibility. They send you from the Check Fraud Dept. to the Identity Theft Dept. to Customer Service to the Branch and they always screw up. When they screw up, they tell you tha tyou filed the wrong paperwork.
Since, Nov. 4, 2008, I have spent almost every waking hour trying to protect myself, file reports, file claims, send emails, make phone calls, etc. B of A is to blame for this (although it is unlikely it will ever be proven that they leaked my info. This has taken a toll on my emotionally and psychologicall, somewhat financially. I am a complete mess.
Anyone who is interested in filing a suit, I am game? Please let me know. I live near Sacramento and will likely attempt to contact an attorney in that town.

I AM 100% ON YOUR SIDE MAN! I MYSELF, AM IN THE MIST OF A NIGHTMARE WITH BOFA! WHAT IT AMOUNTS TO IS THAT THEY DEBITED MY CHECKING ACCOUNT FOR $546 AND CHANGE THAT THEY CLAIMED I OWE THEM FOR AN OVERDRAWN ACCOUNT THAT I HAD…YES THAT WAS TRUE AND I PAID THEM OVER 2 YEARS AGO WHEN I OPENED UP A NEW BANK OF AMERICA ACCOUNT AND ANYONE WHO KNOWS BOFA KNOWS THAT THEY WILL NOT OPEN A NEW BANK ACCOUNT FOR ANYONE WHO OWES THEM MONEY…BUT BECAUSE I CANNOT SHOW THEM MY COPY OF THE RECEIPT THEY REFUSE TO GIVE BACK MY MONEY! THEY SAY YOU CAN WRITE A LETTER TO THE C.E.O. AND HE WILL HELP? WELL I DID THAT AND THE LETTER WAS INTERCEPTED BY THE SAME ASSHOLE THAT WAS NO HELP OVER THE PHONE…SOME GUY NAMED O’BRIEN AND HE IS AN ASSHOLE TOO! I HATE BANK OF AMERICA. THEY ROBBED MY ACCOUNT OF $546 AND LEFT ME WITH $99 AND THEY ARE DEAD WRONG ON THIS ISSUE. THEIR SYSTEM IS FUCKED UP AND THEY DON’T EVEN GIVE A FUCK. You unfortunately are one of the many who have been victims of Bank of America. They did the same to me except it was discovered their were also bank accounts opened in my name try 220 of them….my story is on this site. I only want justice for all of us…nothing more or less.

I have a story as well with Bank of America they rank one of the top two banks for identity theft. In my case they didn’t even provide any ID and they walked out with huge amounts of cash.

Are all these issues regional? I have larger funds in a smaler bank and bill funds in BOA. BOA has my business, my employers business and nearly everyone I know. Worried!

I have a story where boa accepted counterfiet checks from a person posing as me in california ( I live in florida) they cashed them and then took the money out of my account. They did not ask for I’d, did not know the person (as they were a criminal) and accepted 10 checks at two branches all in 15 minutes. The bank is negligent and failed to follow basic endorsement rules as well as their own internal policies
As a result I lost $10000 this is a grand theft case and I believe that the two tellers that accepted the checks could have been involved. The bank of course has not done the right yet. I am given them three more days before I go public.

Good luck. I had a similar issue with my office manager. she stole my identity and opened up a corporate credit card with the #5 credit card bank in US. (Rymes with Manta, I cant say there name as we are suing the crap out of them).
She then preceeded to wire transfer out of my checking account over $200,000.00 She was not paying suppliers yet all the numbers were good and the accounts all balanced…but she was forging numbers to make it look good.
I asked the bank to refund money and they said no, I was reckless and too bad. I am suing them for negligence and they now say they are not negligent either. Hmmm arguing both sides of same coin.
Here is the rub, they did not follow underwritting proceedure and saw my personal credit rating of 790+ and shit hte bed and gave her the card. Funny, my card was never used, only the employee card was used…for everything including brest implants.
Any the bank says I’m reckless. I even have testimony on record whereby they have, as it appears to be lying ot the investors.
The bank has threatened me into oblivian if I publish a pres release regarding this even though I am printing the truth.
Bottom line, our current bank issue and up coming credit card issues are strickly due to bank negligence in how they have investigate peopel and thier underwritting processes.

I’m not sure if you would still this as I see you posted this; however I have a horrible experience with BOA. They released to someone $1.6 million from my accounts. Then did not incestigate and charged me $4000 in NFS fees and reported to me to the check systems and locked my other accounts.

My bank of america saving account was stolen with online transfers to a checking account. I don’t have a checking account with bofa. I received quarterly statements. Due to the fact the transfer is over 60 day old them couldn’t help me. What? That’s my money and them can’t tell me what happen to it. That’s just wrong, not investigating a crime to see what happen to my funds, I’m very up set.
